The terms of service and end user licence agreement for Birma, a reminder app developed and operated by KurdiCode.
This document is both the Terms of Service and the End User Licence Agreement (EULA) for Birma. It is an agreement between you and KurdiCode. Please read it before you use the app or buy a subscription. Section 19 requires most disputes to be resolved by individual arbitration and waives your right to a jury trial and to participate in a class action. You can opt out of that within 30 days — section 19 explains how.
By downloading, installing or using Birma, you agree to these Terms. If you do not agree, do not use the app. Birma is a reminder, habit-tracking and productivity application for Android and iOS, developed and operated by KurdiCode (“we”, “us”, “our”).
We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to install and use one copy of Birma on devices you own or control, for your own non-commercial use, in line with these Terms and with the usage rules of the app store you installed it from.
You may not sell, rent, sublicense or redistribute Birma; copy or modify it except as your app store or applicable law allows; reverse-engineer, decompile or disassemble it except to the extent that restriction is unenforceable under applicable law; remove any copyright or ownership notice; or use it to build a competing product. Birma, its source code, design, artwork and name remain our property and are protected by copyright and other laws. Nothing here transfers ownership to you.
You must be at least 13 years old, and old enough to form a binding contract where you live, to create a Birma account or buy a subscription. If you are under the age of majority, you may only use Birma with the involvement of a parent or guardian, who accepts these Terms on your behalf.
Birma works with no account at all. If you choose to create one for cloud sync, you are responsible for the accuracy of the details you give us, for keeping your password confidential, and for everything that happens under your account. Do not share your credentials or let anyone else use your account.
Tell us at support@kurdicode.com as soon as you suspect any unauthorised use. We are not liable for loss arising from someone else using your account before you tell us, unless that use was caused by our own failure. We may suspend an account we reasonably believe has been compromised, and we may reclaim an account created with details that are not yours.
You retain full ownership and rights over all the data you input, and we never sell it or use it for advertising.
You are responsible for the content you create in Birma, for having the right to store it, and for keeping your own copies of anything important to you. Birma offers cloud sync and a Google Drive backup, but neither is a guarantee against data loss, and you should not treat the app as your only copy of anything you cannot afford to lose. If you turn on cloud sync or Drive backup, you grant us only the narrow permission needed to store, transmit and restore that data for you — nothing more. How each feature handles your information is set out in the Privacy Policy, which forms part of these Terms.
Birma works fully offline and requires no account. Optional features — cloud sync, Google Drive backup, calendar sync, the AI assistant and Birma Pro — send only the data that feature needs, over an encrypted connection, and only after you turn them on. See the Privacy Policy for exactly what each one shares.
The AI assistant is off until you switch it on. Before the first request Birma shows you a disclosure naming what is sent and who receives it, and sends nothing until you agree; you can withdraw that agreement at any time in Settings → Privacy & Permissions.
AI replies are generated by a machine learning model and may be inaccurate, incomplete or out of date. Treat them as suggestions, not as fact, and check anything that matters before you act on it. Do not rely on the assistant for medical, legal, financial or other professional advice. You are responsible for what you send to the assistant and for what you do with its output, and you agree not to use it to generate unlawful, harmful or infringing content. Availability, daily limits and the underlying model may change at any time.
Birma is not a medical device and does not provide medical advice, diagnosis or treatment.
Birma’s medication reminders, allergy and profile fields, energy tracking and related features exist to help you organise information you have entered yourself. They are not a substitute for professional medical judgement, and must never be relied on as the sole means of taking, timing or withholding a medication. Reminders can fail to arrive for reasons outside our control — a phone that is off, out of battery, in a battery-saving or do-not-disturb mode, or an operating system that delays or drops scheduled alerts. Always follow the instructions of your doctor, pharmacist or other qualified professional, and seek their advice before making any health decision. If you think you may have a medical emergency, contact your local emergency services immediately.
Birma is free to use. Birma Pro is an optional auto-renewing subscription that unlocks the Pro features listed in the app. It is offered in three plans — weekly, monthly and annual. The title, length and current price of each plan are shown in the app before you buy and on the app’s store listing; prices vary by country and are set in your local currency by the App Store or Google Play.
If your subscription lapses, Pro features stop working, but the data you created with them stays on your device.
Use Birma lawfully. Do not attempt to breach, probe or overload our servers or the services we rely on; do not use automated means to create accounts or consume the AI allowance; do not attempt to bypass the limits of the free tier or the Pro entitlement; and do not use Birma to store or transmit unlawful material or anyone else’s personal data without their consent.
Some features connect to services we do not control — your calendar provider, Google Drive, your device’s dictation service, the map tiles shown when you pick a location, and the app store that billed you. Your use of those services is governed by their terms and privacy policies, not ours. We do not control their content, availability or accuracy, we are not responsible for them, and a change or outage on their side may change or interrupt the corresponding Birma feature. Any link in the app or in these documents to an outside site is offered for convenience and is not an endorsement.
If you send us ideas, suggestions, bug reports or other feedback about Birma, you grant us a perpetual, worldwide, royalty-free right to use it to improve our products, with no obligation to compensate you and no obligation of confidentiality. You keep any rights you already had in it. Please do not send us anything you consider confidential or that you are not free to share.
We aim to keep Birma and its optional online services running, but we do not guarantee uninterrupted availability, and features may be added, changed or withdrawn as the app develops. We may suspend or terminate access, or an account, if these Terms are seriously or repeatedly breached, or if we are required to by law. You can stop using Birma at any time by uninstalling it, and delete your cloud data at any time from the Account screen. Sections 5, 8, 12, 14, 15, 16, 17, 19 and 20 survive termination.
To the maximum extent permitted by law, Birma is provided “as is” and “as available”, without warranty of any kind, whether express, implied or statutory, including any implied warranty of merchantability, fitness for a particular purpose, accuracy or non-infringement. We do not warrant that Birma will be uninterrupted, error-free or secure, that reminders will always be delivered on time, that synced or backed-up data will always be recoverable, or that AI output will be accurate. Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you, and nothing here limits rights you have as a consumer that cannot be waived by agreement.
To the maximum extent permitted by law, KurdiCode will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits, revenue or goodwill, arising out of or relating to your use of or inability to use Birma — including a missed, late or undelivered reminder — even if we have been advised of the possibility of such damages. Our total aggregate liability arising out of or relating to Birma is limited to the greater of the amount you paid us for Birma in the twelve months before the claim arose, or US$50. These limits apply to every theory of liability, whether contract, tort, negligence, strict liability or otherwise, and apply even if a limited remedy fails of its essential purpose. Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be excluded.
You agree to indemnify, defend and hold harmless KurdiCode and anyone acting on its behalf from any claim, demand, loss, liability or expense (including reasonable legal fees) arising out of or relating to: your misuse of Birma; your breach of these Terms or of any law; content or personal data you store or transmit through Birma without the right to do so; or your reliance on AI output or on a reminder in a way these Terms tell you not to. We will tell you promptly about any such claim, and you may not settle it in a way that imposes any obligation on us without our written agreement.
These terms apply if you obtained Birma from the Apple App Store, and are in addition to the rest of this agreement:
If you obtained Birma from Google Play, your use is also subject to the Google Play Terms of Service. Google is not a party to this agreement and is not responsible for Birma. Purchases and refunds are handled by Google under its policies.
These Terms are governed by the laws of the Commonwealth of Virginia, United States, without regard to its conflict-of-laws rules.
Talk to us first. Most problems can be sorted out quickly. Before starting any formal proceeding, email support@kurdicode.com describing the issue and what you would like done. We will try to resolve it with you within 30 days.
If we cannot resolve it informally, you and KurdiCode agree that any dispute will be settled by binding individual arbitration, not in court, and that each of you waives the right to a jury trial and to take part in a class or representative action.
Arbitration will be administered by the American Arbitration Association under its Consumer Arbitration Rules, before a single arbitrator. It may be conducted on documents, by phone or by video, or in person in Virginia. The arbitrator’s decision is final and may be entered as a judgment in any court with jurisdiction.
Exceptions. Either of us may bring an individual claim in small-claims court instead, and either of us may ask a court for an injunction to protect intellectual property or to stop unauthorised access. Nothing here prevents you from reporting a matter to a regulator.
How to opt out. You can decline arbitration entirely. Email support@kurdicode.com with the subject line “Arbitration Opt-Out” within 30 days of first accepting these Terms, stating your name and the email address you use with Birma. Opting out costs you nothing and changes nothing else about your use of Birma; disputes would then be heard by the state or federal courts located in Virginia.
If the class-action waiver above is found unenforceable as to a particular claim, that claim — and only that claim — is removed from arbitration and heard in court; the rest of this section still applies. If arbitration as a whole is unenforceable where you live, the courts of Virginia have jurisdiction, subject to the paragraph below.
Consumers outside the United States. If the mandatory consumer law of your country of residence does not permit arbitration agreements, or gives you the right to bring proceedings in your local courts, this section does not deprive you of those rights or of the protection of that law.
We may update these Terms as Birma changes. We will post the updated version on this page and change the date shown above, and where the change is material we will give notice in the app. Continued use of Birma after an update means you accept the revised Terms.
